Commercial Leasing Checklist.

Decide what the business needs

• Your use, described the way a landlord and the city will read it
• Size range in square feet, and the minimum that still works
• Areas your customers and staff can reach easily
• Parking, loading, power, plumbing, and ventilation requirements
• Signage and visibility you need from the street
• The date you must be open, working back from your current lease end

Set the budget

• A monthly budget for total occupancy cost, not only base rent
• Cash available for deposits, build-out above any allowance, furniture and equipment
• How long you want to commit for, and whether you want renewal options

Ask on every tour

• Is my use permitted here, and does anyone hold an exclusive that would block it?
• What are the current NNN charges, and what was last year’s reconciliation?
• What condition will the space be delivered in, and who fixes the heating and cooling?
• Is a tenant improvement allowance or free rent available?
• When would rent start relative to getting the keys?
• What will the landlord ask for: financials, a personal guarantee, a deposit?

Before you sign

• Compare options on total cost over the whole term (try the occupancy cost calculator)
• Confirm permits, zoning and business licensing for your use
• Have an attorney review the lease and any personal guarantee
• Read the assignment, subletting and renewal clauses with your plans in mind
